Terms and Conditions

By using The Hampstead Factory website www.thehampsteadfactory.co.uk and/or any service supplied by Hampstead Factory You are agreeing to the terms and conditions below.

Please note we have additional terms and conditions which apply to our acting as agents of the child for any professional acting work.

Definitions

  • "You" means the user of the Site and parent of a Hampstead Factory student;
  • "We/us" means The Hampstead Factory;
  • "Website" or "Site" means the sites located at the URL  www.thehampsteadfactory.co.uk
  • "Content" means the information and other material available within the Site.

Parental consent

We shall not accept a child on any programme which we run without prior written consent of the child's parent or legal guardian.

Payment

Group lessons

Group lessons shall be invoiced (via The Hampstead Factory Newsletter) at the commencement of each term for a child's involvement in the Hampstead Factory for that term.

If payment has not been received (including post-dated cheques) within 60 days of the invoice date, Hampstead Factory may claim a debt recovery charge of £30.00 and apply additional daily interest at the Bank of England base rate plus 8% before and after any judgement. Hampstead Factory may charge an administration fee of £5.00 per reminder letter sent after 30 days of the new term date.

Private lessons

Private/shared lessons are invoiced by Hampstead Factory at the end of every term. Hampstead Factory may charge an adminstration fee of £5.00 per reminder letter sent after 14 days of the invoice date where fees are oustanding.

Agency

The Hampstead Factory application form invites parents to sign on behalf of the applicant for Hampstead Factory Agency representation. Once this has been signed and approved The Hampstead Factory undertakes to represent the applicant (and their immediate family where extra's and other agency work has been offered). Agency representation includes The Hampstead Factory overseeing all work from recalls to negotiating fees, child licences, on-set conditions and other disputes of any kind before, during and after a production.

Hampstead Factory requests that a child's contact details ARE NOT GIVEN OUT to casters or any production staff at auditions sent from The Hampstead Factory. Failure to adhere to this request may result in The Hampstead Factory permanently withdrawing representation for a child in the future.

 

Agency Fees

The Hampstead Factory agency is for the attention of industry professionals only (password secure). It is understood that joining the agency does not guarantee a child work and that commission of 20% (this may vary for specific work) may be collected by Hampstead Factory on any work undertaken. This includes "extra work" where a job has been secured by a child or their family (parents/siblings included) through Hampstead Factory agency information via emails/school notice board or phonecalls. An adult must always accompany children to castings.

Termination

You agree to give a minimum written notice (by lesson 7) of a child's intention to leave The Hampstead Factory at the end of that term. If such notice is not given then you shall be liable to pay a term's fees in lieu of notice.

Grievances must be taken up with The Hampstead Factory in writing within 30 days of the dispute.

We may terminate your right to use this Website for any breach of these terms and conditions.

The contents of this website are copyright The Hampstead Factory 2004.  The copying or incorporation into any other work of part or all of the material available on this Website in any form is prohibited. You agree not to (or to facilitate any third party to) copy, transmit, distribute, publish, commercially exploit or create derivative works of the Content without prior written permission from The Hampstead Factory.

All images of children on this Website are posted with the consent of the child’s parent or legal guardian.  If you wish us to remove an image of your child then please contact us.

User ID

When Registering to use the services available through the Website You must choose a user identification and password. You are responsible for all actions transacted or undertaken through your registered account. You may not sell or otherwise transfer your user identification and password to any third party nor allow any other person to utilise your user identification or password.

Your Right to Cancel

By agreeing to these terms and conditions you accept that the provision of any services through this Website shall commence within 24 hours and you agree that your right to cancel under the Consumer Protection (Distance Selling) Regulations 2000 shall thereupon cease.

Warranty

The Site and the content (which includes Content that is supplied to us by third parties either directly or indirectly) is provided on an "as is" and "as available" basis and we make no warranties or representations, whether express or implied, in relation to the Site or the Content, including but not limited to, implied warranties or conditions or completeness, accuracy, satisfactory quality and fitness for a particular purpose.

Liability

You agree that The Hampstead Factory shall not be liable for any loss or damage whatsoever arising directly or indirectly from or in any way connected with the Site or your use of or reliance upon the Content or any information you obtain by means of the Site or any bookings or purchases you make from third parties through your use of the Site, including, without limitation, damage for loss of profits, loss of business, or any other consequential or pecuniary loss (even where we have been advised of the possibility of such loss or damage).

Notwithstanding that appropriate steps have been taken to ensure that the information in our directories is accurate, The Hampstead Factory(and those organisations on whose behalf we publish various directories) cannot accept liability for reliance placed on the contents and/or any omissions which may occur. Those employing performers or specialists from our directories must make their own enquiries of the performer / specialist to satisfy themselves that he/she is competent to perform the skills required.

You agree and acknowledge that you are solely responsible for evaluating any goods or services offered by third parties via the Site. You acknowledge any bookings or purchase of goods or services made with a third party via the Site shall be subject to the terms and conditions of the third party supplying the service and/or goods concerned and that we will not be a party to or in any way responsible for or liable to You in respect of any transactions between You and third parties.

We do not make any representations or warranties as to the security of any information you might be requested to give to any third parties.

Offers

From time to time we may make offers through this Site to members or prospective members (for example the “refer a friend” scheme which we run). Please note that separate terms and conditions apply to such offers and members of Staff will be happy to supply these to you on request.

Availability of the site

You acknowledge that it is technically impossible to provide the Site and its e-mail services free of faults and that we do not undertake to do so; that faults may lead to temporary unavailability of the Site and related e-mail services; and that the operation of the Site and related e-mail services may be adversely affected by conditions and performances outside our control, including, without limitation, transmission and telecommunications links between us and you and between us and other systems and networks.

Links to other sites

We may provide links to other websites. You acknowledge and agree that we are not responsible for the availability of such external sites, and do not endorse and are not responsible or liable for any content, advertising, products, services or other materials on or available from such sites.

Use of the site

You undertake: not to use the content including photographs or e-mail services for any unlawful purpose; that you shall not make any use of the Site or e-mail services such that the whole or part of the Site is interrupted, damages, rendered less efficient, or the effectiveness or functionality of the Site is in any way impaired; not to use the Site or its e-mail services for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety.

Changes to these terms and conditions

We reserve the right to change these terms and conditions from time to time. By continuing to use the Site following such change you will be deemed to have accepted such change. It is your responsibility to check regularly to determine whether these terms and conditions have been changed. If you do not agree to any such change you must immediately stop using the Site.

Entire agreement

These terms and conditions (as amended from time to time) together with any document expressly referred to in them comprise the entire agreement between you and us.

Severability

Each provision of these terms and conditions excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other provisions is held to be inapplicable or unenforceable in any circumstances.

No waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

English Law

These terms and conditions shall be governed by English law and you submit to the exclusive jurisdiction of the English Courts.
